【トロント、ロサンゼルス2014年4月16日PRN＝共同JBN】カナダ最大の玩具・エンターテインメント会社で飛行玩具の世界リーダーであるSpin Master Ltd.は16日、Brix n Clix, Rehco LLC 、CYI Inc.に対する民事訴訟を米カリフォルニア州中部地区連邦地裁に起こした（訴訟番号2:14-cv-02808）と発表した。訴状によると、被告両社は手のひらを使って空中でコントロールできる飛行人形であるベストセラーのFlutterbye（登録商標） Flying FairyについてのSpin Masterの権利を侵害しているとして、原告は"Starfly" 玩具の製造、販売を両社に禁止させることを求めている。

訴状は被告両3社によるStarflyのマーケティング、販売は「Spin Masterの人気のあるFlutterbye Flying Fairyの成功を利用して違法に利益を得ようとする3社の計算された試みである。独自に自社のオリジナルな製品を製作するのではなく、3社は共謀してSpin Masterが著作権を持つflying fairy玩具と外観、色彩、スタイル、包装が実質的に同様のよく似たflying fairy（"Starfly"と呼ばれる）を－まがいもののマーケティング・キャンペーンで－をつくり出した」と主張している。著作権侵害に加えて、訴状には偽の原産地表示、トレードドレス侵害、不公正な競争の指摘が含まれており、損害賠償やその他の形態の救済を求めている。

Flutterbye Flying Fairyは世界的なヒットになり、全米玩具協会から2回にわたり「トイ・オブ・ザ・イヤー」に選ばれたことを含め、多くの賞、栄誉を獲得した。FlutterbyeラインのFairy玩具の成功により、Spin Masterはすでに世界中で偽造問題に対処しなければならなかった。最近数週間にSpin Masterは偽造をやめさせるために中国で2件の訴訟を起こし、自社の権利を守ることに引き続きコミットしている。Spin Masterの法律顧問クリス・ハース氏は「Spin Masterは積極的に自社のブランドと製品を守っており、本日起こした訴えは自らの利益のためにわが社の知的財産に不適切な行為をする企業を厳しく追及するSpin Masterの意向の表れである」と語っている。

Spin Master Sues Brix N' Clix, Rehco LLC and CYI Inc. for Alleged Copyright Infringement of Flutterbye Flying Fairy

Spin Master Ltd., Canada's largest children's toy and entertainment company and

the world leader in flying toys, announced today that it has filed a civil

lawsuit against Brix n Clix, Rehco LLC and CYI Inc. (the "Defendants") in the

United States District Court for the Central District of California - Case

2:14-cv-02808. The lawsuit seeks to enjoin the Defendants from the manufacture

and selling of the Defendants' "Starfly" toy, which according to the lawsuit,

infringes Spin Master's rights in the best-selling Flutterbye(R) Flying Fairy,

a flying doll that is controllable in the air with the palm of your hand.

The lawsuit claims that Defendants' marketing and sale of Starfly was a

"calculated attempt by the Defendants to illegally capitalize on the success of

Spin Master's popular Flutterbye Flying Fairy toy. Rather than independently

create their own original product, Defendants conspired to create a look-a-like

flying fairy (called "Starfly") that is substantially similar to Spin Master's

copyrighted flying fairy toy in appearance, coloring, styling, and packaging

-along with a copycat marketing campaign." In addition to copyright

infringement, the lawsuit includes claims of false designation of origin, trade

dress infringement, and unfair competition and seeks damages and other forms of

relief.

Flutterbye Flying Fairy has become a global hit and has garnered numerous

awards and accolades including two Toy of the Year nominations from the Toy

Industry Association. Given the success of the Flutterbye(R) line of fairy

toys, Spin Master has already had to deal with counterfeiting problems around

the world. In recent weeks, Spin Master filed lawsuits in China to stop two

counterfeiters, and it remains committed to protecting its rights. "Spin Master

aggressively protects its brands and products and the action we have taken

today is part of Spin Master's plans to vigorously pursue companies who

misappropriate our intellectual property for their own profit," says Chris
