【ニューデリー2017年10月9日PR Newswire=共同通信JBN】これまで、物品サービス税(GST)をめぐり一般輸出業者、特にサービス輸出業者は特有の苦境に直面していた。言い換えれば、ボンドないし念書(LUT)を提出する必要である。

この体制の下、輸出見積りに適用される15%以下の課税の銀行保証を添えたボンドの提出は、全輸出業者、特に前会計年度、すなわち2015-16会計年度に輸出売上高の10%以上(少なくとも1000万ルピー)を受けた実績のないサービス輸出業者がやらなければならないことだった。このため、新興企業を含む全ての新サービス輸出業者には、GSTによる推定納税額15%の銀行保証を添えて商務省にボンドを提出するという困難な作業があった。この銀行保証提出の要件は、長年活動し、2015-16会計年度の外為現金化が規定の上限1000万ルピー以下の小規模サービス輸出業者にも適用された-。ニーラジバガト&カンパニー(Neeraj Bhagat & Co.)の公認会計士であるニーラジ・バガト氏はこのように語った。GSTの下、銀行保証の提出義務は、特にGST導入前にそのような要件が存在していなかった事実を考えると、小規模サービス輸出業者、新興企業に打撃を与える。

2017年10月4日付で、2017年中央物品・サービス税規則(Central Goods and Services Tax Rules, 2017)96AによりLUTの便宜を全輸出業者に拡大する新たな中央税通知37/2017号(https://taxguru.in/goods-and-service-tax/cbec-extends-facility-lut-exporters.html/ )が発せられた。

▽LUTによる輸出適格性

LUTによる輸出便宜は、輸出用の物品・サービスを供給しようとする全登録人に拡大された。ただし、CGST法ないし2017年統合物品・サービス税法(Integrated Goods and Services Tax Act, 2017)、その他既存法の違反で訴追され、2500万ルピー以上脱税した者は除かれる。

▽LUTの有効性

LUTは提出会計年度の全期間有効である。

▽LUT便宜の取り消し

CGST規則96A付則(1)が指定する期限に物品が輸出されない場合、登録人が付則で定められた金額の支払いを怠った場合、LUTによる輸出便宜は取り消したと見なされる。

▽LUT便宜の回復

付則で定められた上記の金額がその後支払われれば、LUTによる輸出便宜は回復される。その結果、LUTによる輸出便宜の取り消しから回復までの期間の輸出は、適用統合税の支払い、あるいは銀行保証を添えたボンドによってなされる。

▽ボンド/LUTの書式

FORM GST RFD-11が共通ポータルで入手できるまで、登録人(輸出業者)は物品税関税中央局(CBEC)のウェブサイト(http://www.cbec.gov.in )からFORM GST RFD-11をダウンロードして、正しく記入した用紙を主たる事業所を管轄する副税関長か税関長補佐あてに提出する。

▽自己宣言

LUTの条件が満たされたとする自己宣言は、そうではないとの具体的情報がない限り受諾される。すなわち、2017年10月4日付の中央税通知37/2017号の目的にかなわないことで訴追されていない輸出業者の自己宣言である。立証要件があれば、それは事後に行われる。

▽LUT/ボンド受領の時期

LUT/ボンドは、経済特別区(SEZ)デベロッパー、同ユニット向けを含む輸出の事前要件であり、LUT/ボンドは最優先で処理されなければならない。LUT/ボンドは、輸出業者による上記規定2(d)の自己宣言とともに受理後3営業日以内の受領が明記されている。LUT/ボンドが提出後3営業日以内に受領されない場合は、受領されたと見なされる。

▽銀行保証

LUTによる輸出便宜が全登録人に拡大されたため、ボンドは2500万ルピー以上の事件で訴追された人物によって提出される必要がある。いずれの場合も、ボンドはその金額の15%の銀行保証を添付しなければならない。

▽インド通貨の支払い

ネパール、ブータン、SEZデベロッパー、同ユニット向け物品供給のLUT受領は、適用されるインド準備銀行(RBI)のガイドラインに従う限り、支払いがインド通貨か兌換外貨にかかわらず許容される。LUTによるSEZデベロッパー、同ユニット向けサービス供給も同様に許容される。しかし、ネパールとブータンへのサービス供給は、そのようなサービスに対する支払いをサプライヤーが兌換外貨で受け取る場合に限り、サービス輸出と見なされる。

▽経済特別区デベロッパー、経済特別区ユニットに対する供給も同じ扱い

この通知の規定は、登録人(経済特別区デベロッパー、経済特別区ユニットを含む)が統合税を支払わない経済特別区デベロッパー、経済特別区ユニットに対して行う物品・サービスの税率ゼロ供給に関しても準用される。

▽輸出商にもLUTの資格

輸出商がGST体制下で納税していない製造業者から物品を購入するためのCT-1用紙の発給に関しては規定がない。製造業者と輸出商の取引は供給の性質を帯びていることから、GSTについても同様の扱いになる。

▽EOUとの取引

税率ゼロは輸出志向型企業(EOU)への供給には適用されず、GST体制下で彼らに対する特別免除はない。従って、EOUへの供給はその他の課税供給と同じく課税対象である。EOUの輸出については、ほかの輸出業者と同様に税率ゼロが適用される。

Execution of LUT Extended to All Exporters

Till now, under GST, exporters in general and services exporters, in

particular, were faced with a rather peculiar predicament viz., of the need to

execute a bond or a letter of undertaking ('LUT')

Under this regime, the furnishing of a bond along with a bank guarantee of (not

exceeding) 15% of the tax applicable on estimated exports was a must for all

exporters including, especially, services exporters who do not have the track

record of having received a minimum of 10% of the export turnover, (which

should not be less than one crore rupees), in the preceding financial year,

i.e. FY 2015-16. Thus, all new services exporters including start-ups had the

daunting task of having to execute a bond with the Department, along with

furnishing a bank guarantee for 15% of the estimated tax liability under GST.

The requirement of furnishing the bank guarantee also applied to smaller

services exporters who were operating over the years, whose forex realizations

were less than the prescribed limit of Rs. 1 crore during FY 2015-16 said

guarantee under GST hit the smaller services exporters and the start-ups,

especially considering the fact that no such requirement existed under the

pre-GST era.

Notification No. 37/2017 - Central Tax dated 4th October, 2017 has been issued

which extends the facility of LUT to all exporters under rule 96A of the

Central Goods and Services Tax Rules, 2017.

Eligibility to Export under LUT:

The facility of export under LUT has been now extended to all registered

persons who intend to supply goods or services for export without payment of

integrated tax except those who have been prosecuted for any offence under the

CGST Act or the Integrated Goods and Services Tax Act, 2017 or any of the

existing laws and the amount of tax evaded in such cases exceeds two hundred

and fifty lakh rupees.

Validity of LUT:

The LUT shall be valid for the whole financial year in which it is tendered.

Withdrawal of LUT Facility:

In case the goods are not exported within the time specified in sub-rule (1) of

rule 96A of the CGST Rules and the registered person fails to pay the amount

mentioned in the said sub-rule, the facility of export under LUT will be deemed

to have been withdrawn.

Restoring the LUT Facility:

If the amount mentioned in the said sub-rule is paid subsequently, the facility

of export under LUT shall be restored. As a result, exports, during the period

from when the facility to export under LUT is withdrawn till the time the same

is restored, shall be either on payment of the applicable integrated tax or

under bond with bank guarantee.

Form for bond/LUT:

Till the time FORM GST RFD-11 is available on the common portal, the registered

person (exporters) may download the FORM GST RFD-11 from the website of the

Central Board of Excise and Customs (http://www.cbec.gov.in ) and furnish the

duly filled form to the jurisdictional Deputy/Assistant Commissioner having

jurisdiction over their principal place of business.

Self-declaration:

Self-declaration to the effect that the conditions of LUT have been fulfilled

shall be accepted unless there is specific information otherwise. That is,

self-declaration by the exporter to the effect that he has not been prosecuted

should suffice for the purposes of Notification No. 37/2017- Central Tax dated

4th October, 2017. Verification, if any, may be done on post-facto basis.

Time for acceptance of LUT/Bond:

As LUT/Bond is a priori requirement for export, including exports to a SEZ

developer or a SEZ unit, the LUT/bond should be processed on top most priority.

It is clarified that LUT/bond should be accepted within a period of three

working days of its receipt along with the self-declaration as stated in para

2(d) above by the exporter. If the LUT/bond is not accepted within a period of

three working days from the date of submission, it shall deemed to be accepted.

Bank guarantee:

Since the facility of export under LUT has been extended to all registered

persons, bond will be required to be furnished by those persons who have been

prosecuted for cases involving an amount exceeding Rupees two hundred and fifty

lakhs. A bond, in all cases, shall be accompanied by a bank guarantee of 15% of

the bond amount.

Payments Made in Indian Currency:

It is clarified that the acceptance of LUT for supplies of goods to Nepal or

Bhutan or SEZ developer or SEZ unit will be permissible irrespective of whether

the payments are made in Indian currency or convertible foreign exchange as

long as they are in accordance with the applicable RBI guidelines. It may also

be noted that the supply of services to SEZ developer or SEZ unit under LUT

will also be permissible on the same lines. The supply of services, however, to

Nepal or Bhutan will be deemed to be export of services only if the payment for

such services is received by the supplier in convertible foreign exchange.

Same Treatment for Supplies to Special Economic Zone Developer or Special

Economic Zone Unit

The provisions of this notification shall mutatis mutandis apply in respect of

zero-rated supply of goods or services or both made by a registered person

(including a Special Economic Zone developer or Special Economic Zone unit) to

a Special Economic Zone developer or Special Economic Zone unit without payment

of integrated tax.

Merchant Exporters also Eligible for LUT:

It is clarified that there is no provision for issuance of CT-1 form which

enables merchant exporters to purchase goods from a manufacturer without

payment of tax under the GST regime. The transaction between a manufacturer and

a merchant exporter is in the nature of supply and the same would be subject to

GST.

Transactions with EOUs:

Zero rating is not applicable to supplies to EOUs and there is no special

dispensation for them under GST regime. Therefore, supplies to EOUs are taxable

like any other taxable supplies. EOUs, to the extent of exports, are eligible

for zero rating like any other exporter.
