タイの最高裁がインフォクエスト・ニュースの著作権を認め、タイのメディア産業の基準を定める

【バンコク2019年4月2日インフォクエスト＝共同通信JBN】タイ最高裁判所の知的財産・国際取引部門は、インフォクエスト（InfoQuest Limited）の記事、特別リポート、インタビューリポートは著作権法B.E. 2537のもとに保護される成果物であり、インフォクエストは争議対象記事の許可のない複製と再配信について補償を受けるべきとの判決を下した。これはタイ最高裁に持ち込まれた、ニュースに関して初の著作権の事例であり、タイのメディア産業における知的財産と著作権の認識の重要性を喚起するものである。

タイの主要オンラインニュース通信社でニュースサービス・プロバイダー（経済、金融、株式、投資ニュースが専門）であるインフォクエストのジャルソン・パタマポンス（Jalthong Patamapongs）会長は、中央知的財産・ 国際取引裁判は2019年3月27日、インフォクエストが原告となったBlack Case No. Tor Por 58/2558とRed Case No. Tor Por 72/2559に関する最高裁の判決を読み上げたと述べた。インフォクエストはBisnews AFE（Thailand）Co., Ltdとその経営陣に対し、著作権侵害とインフォクエストのニュースを許可なく複製・再配信したことについて提訴していた。インフォクエストは記事、特別リポート、インタビューリポート135件を証拠として同封した。

すべての証拠と事実を検討した後、最高裁は135件すべてが単なる当日のニュースあるいはファクツではなく、作者自身の専門性を使って行ったデータと情報分析を含む調査、編集、特定情報の選択、インタビューの結果であると裁定した。さらに最高裁は、これらの作品は勤勉、努力、知性、相当量の労働によって制作されたとし、分析した当該作者の過去の経験と取り組みから養った判断であるとした。最高裁は、前述のインフォクエストの作品は著作権法B.E. 2537による著作権作品であり、インフォクエストはこうした作品への侵害について賠償を得るべきだと裁定した。

ジャルソン・パタマポンス会長は、次のように述べた。

「これはニュースに関して最高裁に持ち込まれたまさに初の著作権侵害事案である。そして今、最高裁は最終判決を下した」

「過去において、ニュースは単なるファクツであり、著作権法に保護されていないとの認識が一般的だった。その結果、コンテンツ所有者の許可なく多くのニュースコンテンツがコピー、複製、再配信された。今回の判決はタイメディアにとっての著作権の基準を定め、知的財産とニュース作品に関連する権利について人々が認識することになるだろう」

「この最高裁の決定はタイで活動する国際的なニュース通信社、そしてインフォクエストと同様のニュース作品に対して前向きな効果をもたらすだろう。こうした機関は、タイの知的財産法が国際基準に従ってニュース作品を保護するという確信を持てるだろう」

Thai Supreme Court rules InfoQuest news is copyrighted – setting norm for media industry in Thailand

Bangkok, April 2, 2019

The Supreme Court, the Intellectual Property and International Trade Division, ruled that articles, special reports and interview reports of InfoQuest are protected work under Copyright Act B.E. 2537 and that InfoQuest shall get compensation from unauthorized reproduction and redistribution of the disputed materials.  This is the first copyright case related to news brought to the Supreme Court in Thailand, raising the importance of intellectual property and copyright awareness in the Thai media industry.

Mr. Jalthong Patamapongs, Chairman of InfoQuest Limited, a leading online news agency and news service provider in Thailand specializing in economic, financial, stock and investment news, said that the Central Intellectual Property and International Trade Court read the Supreme Court judgment on March 27, 2019 on the Black Case No. Tor Por 58/2558 and the Red Case No. Tor Por 72/2559 which InfoQuest was the plaintiff.  InfoQuest filed a lawsuit against Bisnews AFE (Thailand) Co.,Ltd. and its directors for copyright infringement, unauthorized reproduction and redistribution of InfoQuest news.  InfoQuest enclosed 135 of its works comprising articles, special reports and interview reports as evidence to the case.

After considering all evidence and facts, the Court ruled that all 135 pieces of works are not merely news of the day or facts, but they are works that resulted from researches, compilation and selection of specific information, interviews, including data and information analyses by the authors using their proficiencies.  The Court further reasoned that these works have been created with diligence, endeavor, intelligence and substantial labor as well as cultivated judgment from previous experiences and initiative of the author in analysis.  The Court ruled that the aforesaid InfoQuest works are the copyright work by virtue of Copyright Act B.E. 2537 and that InfoQuest shall receive compensation for the infringement of the said works.

“This is the very first copyright infringement case related to news that has been brought to the Supreme Court.  And now the Court has made the final ruling.

In the past, people always thought that news was merely facts and not protected by the copyright laws.  As a result, a lot of news content has been copied, reproduced and redistributed without authorization from the content owners.  I believe the ruling on this case will set a norm in copyright for the Thai media and will make them aware of their rights relating to Intellectual Property and their news work.

The Supreme Court's decision on this case should have a positive effect on international news agencies that operate news businesses in Thailand and have similar news work as InfoQuest’s.  These agencies will have confidence that the intellectual property laws of Thailand will protect their news works according to international standards”, said Mr. Jalthong.
